Common questions
General information only. Every case depends on its facts and dates.
What can I do if I receive a GST show-cause notice?
Do not ignore it. A written reply must be filed within the time given in the notice. If an adverse order is passed, an appeal can be filed, and a writ petition may be possible where natural justice was not followed.
Can the department attach my bank account for a tax demand?
Recovery action is allowed only after due process. If an attachment is illegal or premature, a stay petition or a writ petition before the Madras High Court may be possible.
What is a stay petition in tax matters?
A stay petition asks the authority or court to pause recovery of a disputed demand until your appeal or case is decided.
When can a writ petition be filed in the Madras High Court for a tax dispute?
A writ petition under Article 226 is generally considered where there is a violation of natural justice, lack of jurisdiction, or an illegal order or recovery action. Each case depends on its facts.
How soon should I contact an advocate after getting a notice or order?
As soon as possible. Appeals and replies have strict time limits, and early advice helps protect your options.
